CLASS5 – SMS/MMS Terms and Conditions

These SMS/MMS Terms and Conditions (“SMS Terms”) apply to all SMS (short message service) and MMS (multimedia messaging service) communications sent by CLASS5 (“CLASS5,” “we,” “us,” or “our”) to your mobile device.
By providing your mobile number and opting in, you expressly consent to receive SMS/MMS messages from CLASS5 and agree to these SMS Terms.
1. Scope of Service
CLASS5 uses SMS/MMS to deliver:
- Service alerts (outages, maintenance, updates)
- Security notifications (login attempts, password resets)
- Account management (billing, renewal reminders)
- Support responses (ticket updates, live agent replies)
Messages may include text, links, images, or rich media (MMS).
2. Consent & Opt-In
You affirmatively opt in by:
- Entering your mobile number in a CLASS5 web form and clicking “Subscribe to Alerts”
- Providing consent during account setup or support interaction
Your opt-in grants express written consent under the Telephone Consumer Protection Act (TCPA) and CTIA Messaging Principles.
3. Message Frequency
You will receive messages as operationally necessary. Typical volume:
- 0-4 messages per month
- Spikes possible during outages or security events
We disclose frequency at the point of opt-in.
4. Cost Responsibility
Standard message and data rates may apply. You are solely responsible for:
- Carrier SMS/MMS fees
- Data charges for links or media
- International roaming fees (if applicable)
CLASS5 does not charge for messages.
5. Supported Carriers & Delivery
Messages are sent via major U.S. carriers and select partners. Delivery is not guaranteed due to:
- Carrier filtering (spam blocks)
- Do Not Disturb (DND) settings
- Network congestion
- Invalid or ported numbers
- Device limitations (e.g., full inbox)
6. Opt-Out (STOP)
To stop all SMS/MMS, reply to any message with: STOP
You will receive one final confirmation:
“You will no longer receive messages from CLASS5. Please reply HELP to learn more, or RESUME to remove this block.”
Opt-out takes effect automatically.
7. Help Command
Reply HELP to any message. You will receive:
“You are receiving this message from CLASS5. We can be reached at 360-949-1381 or support@class5technologies.com. Reply “STOP” and we will never text you again.”
8. Data Usage & Privacy
We collect and store:
- Mobile number
- Carrier name
- Opt-in timestamp and method
- Message status (sent, delivered, replied)
Data is used only for:
- Message delivery
- Compliance auditing
- Service improvement
No sale or sharing with third parties except as required by law or for delivery.
9. Your Responsibilities
You agree not to:
- Use messages for harassment or spam
- Share one-time passcodes (OTPs)
- Attempt to exploit short codes or systems
- Provide a number you do not own or control
10. Liability Limitations
CLASS5 is not liable for:
- Undelivered or delayed messages
- Carrier fees
- Damages from reliance on message content
- Interruptions due to force majeure
11. Changes to These SMS Terms
We may update these SMS Terms.
- Changes posted at this URL
- Continued receipt of messages = acceptance
12. Governing Law
Washington law applies. Disputes resolved via binding arbitration in Clark County, WA.
